The Immigration and Nationality Act of 1952

How Does This Affect Us Today?

Not only was this a big deal back then, but it continues to effect us to this day. Firstly, it is still being enforced in our immigration policies. It has been in action since it was passed in Congress on June 27th, 1952. Not only that, but Jimmy Carter used this act to deport and detain Iranians during th Iran hostage crisis.


The McCarran Walter Act was made to keep out communists, but now it is being used in the War on Terror. It is being used against Arabs and Muslims suspected of subversion.


​​​​​​​When Donald Trump advertised his plans for a Muslim Ban, he brought up the Immigration and Nationality Act of 1952. This Act actually gives him the power to make a Muslim Ban.


In the act, Section 212(f), states: “Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate.”.
